The Ministry of Justice's Legislative Council released a document on March 29 2021, regarding the revision of the Family Law, which is clearly contrary to today's global trend in view of the welfare of children to be jointly reared after divorce.
The revision of the Family Law Act planned by the Ministry of Justice is clearly contrary to Article 9 of the Convention on the Rights of the Child, and should not be internationally accepted.
Aligning Japan to Children Rights international standards under these circumstances, we have set up the Private Sector Family Law Subcommittee of the Legislative Council, and on May 31 2022, its chairperson, Lawyer Haruo Kitamura, submitted the Interim Draft to Sanae Takaichi, the policy chief of the Liberal Democratic Party.
The Private Council included members from France, Italy and Australia, and through discussions among the members, we were able to indicate a direction that fully takes into account the Convention on the Rights of the Child.
